Terms and Conditions of Passenger Transport

Terms and Conditions of Passenger Transport

§ 1 – General Provisions

The terms used in these regulations shall mean:

  • Carrier – the transport company "Parabus," registered in CEIDG under the name Parabus Łukasz Wierucki, NIP 8652248569.

  • Passenger – a natural person using the services of the aforementioned carrier.

  • Baggage – movable items taken by the traveler into the vehicle.

§ 2 – Conditions of Carriage

  1. The Carrier undertakes to transport the Passenger and their baggage to a designated place or along a designated route including multiple intermediate stops.

  2. The Carrier undertakes to make every effort to transport the Passenger and their baggage within the designated time. Due to the specific nature of the carrier's operations (irregular, occasional transport), departure and arrival times are determined individually, are not guaranteed, and do not constitute part of the transport contract.

  3. The Carrier is not liable for delays and their further consequences beyond the Carrier's control, caused by administrative factors (e.g., police checks, customs inspections, ITD inspections) or other factors independent of the Carrier (e.g., weather conditions, traffic difficulties or border crossing delays, unpredictable technical problems, etc.), nor for any further unspecified consequences resulting from them.

  4. In exceptional situations (e.g., vehicle breakdown, collision, etc.), the Carrier will make every effort to allow the Passenger to continue the journey as quickly as possible. In such situations, the Carrier may change the vehicle or change the transport service provider. The Passenger incurs no additional costs for this.

  5. The Carrier is obliged to comply with all legal regulations (including road traffic law, transport law, regulations regarding the sale of services, etc.). These laws take precedence over the individual needs of the Passenger and cannot be restricted or violated by the Passenger in any way.

  6. The Carrier is entitled to refuse to perform the transport (or its continuation) without the need to refund costs incurred by the Passenger in connection with the trip if the Passenger:

    • Fails to comply with the terms of these Regulations.

    • Is under the influence of intoxicants or a significant amount of alcohol.

    • Behaves in a manner that is burdensome to fellow passengers or the driver.

    • Behaves in a way that threatens the safety and health of fellow passengers or the driver.

    • Does not possess the required documents for crossing the border, fails to comply with customs and foreign exchange regulations, is refused entry into a country by its authorities, or carries prohibited goods.

  7. The Carrier shall not be held liable for the provision of an incorrect address by the Passenger.

  8. For failure to perform the transport service due to the Carrier's fault, the Passenger is entitled to a refund of the amount equivalent to the service paid for.

§ 3 – Passenger Obligations

  1. For trips where arrival time is critical (e.g., airport transfers, matches, concerts, weddings), the Passenger should allow for an appropriate time buffer, considering speed limits, weather, and traffic.

  2. For an agreed departure time, the Passenger should be ready at the indicated address 10 minutes before the scheduled departure.

  3. The Passenger is obliged to fasten seat belts and follow the driver's instructions regarding transport in accordance with the law.

  4. For international transport, the Passenger must hold a valid document for border crossing and all other required certificates.

  5. A total and absolute ban on smoking (including e-cigarettes), consuming alcohol, and using intoxicants applies inside the vehicle.

  6. During journey breaks, the Passenger must adhere to the designated break time and not cause delays or the need for a search due to negligence.

  7. The Passenger is liable for any damage caused to the Carrier (including damage to vehicle equipment) and other Passengers under general Civil Code rules.

  8. A Passenger who intentionally or through negligence soils or damages the vehicle is obliged to pay an amount equivalent to the costs of full repair. If the damage results in the vehicle being taken out of service, the Passenger is additionally obliged to pay a contractual penalty of 500 PLN for each day of decommissioning.

§ 4 – Transport of Children

  1. Children under 12 must travel under adult supervision. If the adult is not a parent or legal guardian, an "Authorization for the Transport of a Minor" is required. For school/kindergarten services, this obligation lies with the ordering institution.

  2. Children under 18 whose height does not exceed 150 cm must travel in an appropriate safety seat adapted to their height and weight.

  3. A safety seat can be requested from the Carrier at least 24 hours before the service.

  4. Due to the lack of lateral protection and proper belt guidance, the Carrier excludes the possibility of transporting children on booster cushions or "stools."

  5. Passengers may use their own safety seat (not a booster) only if it meets current legal approval standards.

  6. Failure to report the need for seats 24 hours in advance or not having one's own will result in a refusal of service, with the customer charged 100% of the costs incurred (travel, fuel, driver, etc.).

§ 5 – Baggage

  1. The Passenger is entitled to free transport of up to 2 pieces of baggage with a total weight not exceeding 30 kg and dimensions not exceeding 80 cm × 60 cm × 30 cm per item.

  2. Larger or additional baggage requires Carrier consent at least 24 hours in advance.

  3. It is forbidden to carry materials or objects that may threaten transport safety, cause damage to others, or cause discomfort to fellow travelers.

  4. Carrying animals is prohibited unless the Carrier gives consent at least 24 hours before the service.

§ 6 – Booking

  1. Reservations must be made via phone, email, or the online form.

  2. The Carrier will provide a quote after the request.

  3. The Passenger must confirm the booking by paying a deposit. The amount is determined individually.

  4. Cancellation policy:

    • More than 24h before: 100% deposit refund.

    • Between 12h and 24h before: 50% deposit refund.

    • Less than 12h before: Deposit is non-refundable.

  5. Booking is confirmed only after the full deposit is credited to the Carrier’s account.

  6. By making a reservation, the Passenger accepts these regulations.

§ 7 – Fees

  1. The service fee is calculated based on an individual mileage or hourly rate, plus additional fees (parking, tolls, etc.).

  2. Payment is divided into:

    • A deposit paid by transfer 24h before the service.

    • Final payment in cash or by card to the driver after the service.

§ 8 – Complaints

  1. Complaints must be submitted in person, by post, or by email within 30 days of the incident.

  2. The Carrier will process complaints within 30 working days.

  3. Complaints regarding baggage in the cargo hold must be made immediately upon receipt to the person handing over the baggage.

  4. Items left behind by the Passenger are not the responsibility of the Carrier.

  5. In case of baggage loss due to the Carrier's fault, the maximum compensation is 500.00 PLN.

§ 9 – Final Provisions

  1. For matters not regulated here, the provisions of the Act on Road Transport and the Civil Code shall apply.
